This is a perfect example of creating more problems for everyone including yourself. IF everyone applies 2 H1 just to make sure there probability increases the overall probability of one getting H1 stays the same. The problem comes when someone plays by book and applies only one H1. By your action his probability is decreased. This is something my conscious won’t allow. When i was applying a H1 i had option to go for a regular H1 or last years left over masters Quota (The first year masters Quota opened, USCIS started accepting applications in Jan for that already started fiscal year). I decided to go for the Masters one so that i don’t use up a number from the coming year’s regular or masters quota .. i could have saved money staying on OPT but i did not
Moral of the story …. please think about ur actions and be considerate to others. We is stronger then me.

I would suggest to build a wind mill and generate own power next winter

My a** was burned with big electricity bill last winter when I was in apartment . If I put 70 hall will be very hot and bed room will be very cold. If I put 75 bed room is ok but people in hall are sweating. No proper control because of poor maitenance and also the apartment location.

You will be surprised I am paying less power bill now in new house of 2500 SQFT than I was paying in 1100 SQFT apartment (with no one at home from 8 AM to 6 PM and all lights off by 10.30 PM).

I am repeating myself, most of the times it is because of the poor maintenance of the heating system. That causes the system to run all the time.Ask how long ago the management did maintenance to the heating system (not just replacing the filter twice a year which doesn’t do anything other than clean air)

I’m also on the same boat. I cannot go back to company A as they are shutting down the shop.

I think the shot turned out great Michael. I imagine you could use a similar technique as I have been doing with the infrared, with the filter off and the camera on a tripod using the autofocus to get focus where you want it then switch to manual focus and screw the filters on then take your picture. I’m also curious how much different shooting the same shot without the filters or possibly just one and setting the aperture at f/32 and using a slow shutter to try to achieve the same effect. Look forward to more experimentation.

My question is, is it possible to even file for COS from H4 to F1 after getting F1 denied in India .

Here is the timeline

Nov 2010 – COS from H4 to F1 approved in US.
Dec 2010 – Went to india for F1 Stamping and it was denied.
Jan 2011 – Came to US on H4 visa .

Now is it possible to apply for COS to F1 again ? . Will the F1 denial in India have any impact on COS to F1 processing ?

Yes, you can. Since the person is already in the US, this should not be a problem. One of my friend’s wife lost her H-1 job, applied for a school here, got her I-20 and went to India for F-1 stamping. When it got denied, she applied for F-2 visa (as my friend was in F-1), and then after coming back to US, changed back to F-1 and went to school. Then she found a job on OPT and now is back on H-1.

"Status" and "visa" are two different things. A "visa" is only required for entry to the US.
I am not sure if the earlier denial of visa stamping will have an affect on a COS application.

Read the Murthy article, looks like DOL is stepping up PERM approvals for non-audited cases (now let’s just pray we who are waiting for PERM don’t get audited!)

As per my attorney, number of PERM applications filed in 2nd half of 2009 is very low (He has some good contacts at Atlanta DOL). He was expecting all 2009 non-audited cases to be processed in a couple of months….Not getting audited is the key in PERM process. My PERM will be finally filed this week, and I am hoping its not going be audited (MS + 6 yrs or BS + 8 yrs exp, 4G Mobile Communications R&D) though my attorney feels it will be….Keeping my fingers crossed…A successful EB3 to Eb2 conversion seems to be the only hope…

I did it all by myself, following directions found here and there around the forum. I got the working permit in about a month. Hope it Helps

I just spoke with my company’s attorney and she said that I shouldnt get RFE on my I-140. And just in case I get she will inform me and work with the counsel of my ported company to submit a response. Hooray….I am going. My employer is a big known MNC so the only RFE that I may get is exp letter which is very unlikely. With economy going down I dont want to wait for another 6 months for my I-140.

ok then go for it dude. Do keep us posted on how this works out, I hope you get your I-140 approved soon without an RFE..

folks – this is what ive been told.

we can file the spouse details and the mariage proof – for AOS ( I forgot the form number ) if you are married but you cant get your spouse into US for some reason. EG you have invoked AC21 using your EAD. which means you have lost H1B and there is NO H4 in scope. So unless you get your GC you cant bring.

In my case, I was on H1B when i got married, ( already filed 485 too before marriage, but did not use EAD till date ) so I could bring my spouse on H4. But the problem is there is no way you could add your spouse to my AOS process, unless my priority dates are current.

Sounds like you found the "sensor", really a filter or glass over the sensor. When you remove the lens, you see the mirror. Put the camera in bulb mode and lock the shutter open, and that’s the "sensor". Ensure that you have plenty of battery power (or are hooked up to the AC/DC adapter) before you stick anything into the sensor cavity. If the shutter closes while you have something in the cavity, the shutter will break, and you will need an expensive repair.

I have to clean my cameras often, since I shoot outdoors and change lenses many times a day. I have found that compressed air takes care of most problems, and a $10 bulb, like Mark mentioned, is the best way to go for field work. If you are willing to put a little more $$ into it, get an oil-less diaphragm compressor for an airbrush, ~$100. The other nice thing about air is that you don’t put anything in the shutter cavity.

DO NOT use "canned air", these little cans with compressed air in them. They contain isobutane and other hydrocarbon propellants which can "spit" out of the can and leave spots on the sensor that will require a liquid cleaning to remove.

Liquid cleaning is more complicated. The Eclipse solution is (I have heard, I don’t use it…) clean methanol. A lot of people use these with ‘pec’ pads with success. I use clean, high grade isopropanol, electronics swabs, and follow up with distilled DI water and the air compressor. This is a delicate process that I don’t recommend experimenting with. If you want to learn how to do this, find someone who is willing to tech you using his camera. Mark probably gets his money’s worth from the camera shop. The only issue is finding a good shop.

Thank you for posting this enlightning article. I think some of it is very true, give it fifty years and oriental Asia will have become an even greater threat to the US� leadership, if not ended it completely. I�ve never looked into this, so I�m asking: Aren�t there different immigration rules that aren�t as strict when you actually study in America? And when you go study there, do you need immigration permission and does it take you this long to get it or what?

This is my first post here but I am silent reader for past two years. I got my GC approved couple of weeks ago. A week before that, I applied for EAD and AP renewal. Is there any way to ask USCIS to refund the money back since they have debited the money from my account and also received the receipt notice for me and my wife as well? I need your valuable suggestion here,

When i went to Mumbai last december i got my H1B stamped. while coming to US i showed the POE my H1B stamped visa he asked me for Advanced parol document and i was Parolled.When i asked him i have a H1B stamped in my passport why do i need to be parolled. He answered AP has a higher preference than H1B.
the bottom line is " H1B stamping will not be considered for your entry". Its just a stamp for your satisfaction.
I am not going to stamp my H1B again. 18 months back when i came from Vancouver Canada the POE let me in by AP not by H1B visa. I asked him about my valid H1B and the POE told me you can enter using either one but we prefer AP.

If you are a local from mumbai then its okay to attend a interview and get stamped. They don’t ask much in my interview. In my last interview they asked me in the picture you have a mouthstach and now you are clean shaven. So that is the level of questions asked at the interview. Its just 2-3 hours of work or maybe half a day if you wish to do it.

One more proble i went through at mumbai consulte, The dates were posted 1 week in advance and then a local person has to go and submit the document to the consulate. the FEDEX from US to India would be costing around 68 to 150 dollars and it needs to be reached within 1-2 days (i.e. 3 days before the interview). I got it done somehow.

I entered on H1 visa this year. Me and my wife both arrived at the airport, I told the officer, my wife has AP and I have H1 visa. To which he said, where is your AP. I said, I have it but I prefer to use H1. Is it possible? He said thats fine. Your choice.

This is my job description before being director and as per my lawyer (absolute hearsay) , "The very purpose of AC21 is to give us relief from working for same jobs over number of years and this is natural progression of job.you are in your SAME field. If it was Director of Finance of Sale, it’s big no no but in this case you are just growing vertically i my professional career. USCIS has very liberal policy in this matter

And yes, you don’t have to inform USCIS about it.
